Booking Conditions

Please read these conditions carefully. They set out the basis of your agreement with Cotterdale Cottage Holidays. In making a booking you are confirming that you are 18 years of age and have the authority, to accept and accept on behalf of your party the terms and conditions set out below.

A binding contract comes into existence between you and Cotterdale Cottage Holidays once we have received your deposit and we have issued confirmation of your booking acceptance by e-mail.

2. CONFIRMING YOUR BOOKING

A deposit of £75.00 per week is required to confirm your booking. If however you are booking within 6 weeks of your holiday, payment must be made in full when confirming your holiday. Please note your holiday is not confirmed until you have received either an email or written confirmation from Cotterdale Cottage Holidays and we reserve the right to refuse any booking before we have issued the written holiday confirmation form. Your booking is made as a consumer and you agree neither the company nor owner will accept liability for expenses, costs, losses, claims or other sums that relate to any business however so suffered or incurred by you. You must be over 18 years of age at the time of making your booking. As soon as you receive the holiday confirmation form, you must check it carefully. Any errors must be reported to us immediately.

3. BALANCE PAYMENT / CANCELLATION

The balance of your holiday is due at least 30 days prior to holiday commencement. This can be paid by forwarding bank transfer


Non Payment of the final balance when it becomes due by more than 14 days will constitute a automatic cancellation of the holiday and forfeiture of: 50% Deposit.

Cancellation by you: Telephone us immediately if you have to cancel and on the same day send us written confirmation by post, email or fax. Your cancellation is affective from the date we receive your written confirmation which will be acknowledged.

4. PAYPAL AND CREDIT CARD PAYMENTS

There is no charge for bank transfer (BAC).

Pay Pal and Credit cards are charged at 7%

5. HOLIDAY COST

The prices quoted are for 3, 4, 7 and 14 night's accommodation from the changeover date Friday and Monday. Included in the price is electric and bed linen (please note bed linen is not provided for cots). Prices quoted are in £ sterling and are all inclusive.

6. SECURITY DEPOSIT

At the moment we do not take a security deposit (we trust you will take great care of our cottages.)

Damage/breakages caused through neglect may be charged for, in this case we will contact you within 10 days of departure.

7. CARE OF COTTAGES

Our cottages are lovingly cared for and we ask that you treat the cottage with respect and leave it clean and tidy. Please report any damages/breakages to Cotterdale Cottage Holidays on or before departure in order for us to fix or replace these prior to the next guests coming in. Damage/breakages caused through neglect may be charged for, in this case we will contact you within 10 days of departure.

Wood burning stove and Real fire: A starter pack of coal and logs is provided for the stove, only use this or prepared fuel which can be bought locally. Do Not put bits of wood you may find on your walks, on the stove as unprepared timber can cause damage to the stove.

8. PETS

Cotterdale Cottage Holidays allow two well behaved pets. We make a surcharge of £16.00 per week per pet. Registered assistance dogs are accepted free of charge. You must bring your own pet basket with you as pets are allowed only on the clear understanding that under no circumstances may they lie on beds, bedding or furniture. Pets must not be allowed upstairs or left unattended in the property or elsewhere. It is the pet owners' responsibility to remove all pet hairs from the interior of the cottage on vacation and all mess from the garden.

PETS & RED SQUIRRELS:

Everyone loves their pets for the companionship and enjoyment that they give. However, they can have a significant impact on red squirrel populations in urban and suburban areas. Here are a few guidelines on how to keep squirrels (and other wildlife) safe whilst still enjoying your holiday.
DOGS
A walk in the woods is great fun for dogs and owners alike. It keeps them fit and provides all the pleasures of the outdoors. However it is important to remember that you are sharing the area with the animals that live there all of the time. Please don't allow your dog to chase squirrels even though it may seem harmless. Squirrels spend a great deal of time and effort foraging for food. Being chased wastes energy that has to be made up, which is especially hard to do in the winter months. It also causes stress, which may have a bad effect on their ability to breed. Extra attention must be paid during breeding months of (March/April & July/August) as females under threat may be forced to abandon their dreys and move their kittens elsewhere putting them under unnecessary threat. At this time it is best to keep dogs on a short lead while in a red squirrel populated area.
CATS
• Treating your cat to a new collar, fitted with a bell. This might just give squirrels enough warning to get away.
• If you feed red squirrels, making sure that the feeder is out of reach of cats.
• It is best to keep cat on a short lead while in a squirrel populated area.

9. BROCHURE DETAILS

Cotterdale Cottage Holidays always try to maintain the very best facilities and services to our holidaymaker's and changes may have occurred since brochure production. However the information may have changed by the time you book so you must ensure you check all details of your chosen property including prices when you book.

11. OCCUPANCY

Your holiday group must not exceed the maximum number of people the property will sleep. Eller Haw Cottage is not to exceed four persons and a baby under 2 and Town Head House six persons and a baby under 2. If it does the owner/caretaker can refuse to allow you to take possession of the property or make you leave before the end of the holiday. If this happens we will treat your holiday as cancelled by you and you will not be entitled to a refund of monies of compensation.

12. TRAVEL COTS & STAIR GATE

Eller Haw Cottage and Town Head House have a travel cot available free of charge. We do NOT provide linen for the cot.
Eller Haw Cottage and Town Head House have a stair gate available you may put up yourself, Cotterdale Cottage Holidays take no responsibility of the stair gate we have supplied been used incorrectly.

13. HIGHCHAIRS

Eller Haw Cottage and Town Head House have a highchair available free of charge.

14. TOWELS

Towels: are included in the rental.

15. KEY COLLECTION/ARRIVAL AND DEPARTURE TIMES

Your property is available from 3.00pm on day of arrival and must be vacated by 10.00am on day of departure.

In some instances we may be able to bring forward the entry time (Surcharge of £20.00) or extend the departure time (Surcharge of £20.00),
However we do require advance notice so we can arrange an extra cleaner, we will only be able to confirm we are able to change the times 14 days before holiday commencement.

Keys must be returned to the collection point which will be given to you on payment of your balance.

16. CAR PARKING

Eller Haw Cottage has car parking for 2 cars directly by the cottage. Town Head House has car parking for 2 cars directly by the cottage.

17. CARE AND SAFETY

Our aim is for you to enjoy your holiday and we will work very hard to ensure you have a memorable and pleasant stay in this unique part of the Yorkshire Dales.

Please remember that when you stay in unfamiliar surroundings, you must take special care of yourself and your family. In particular:

  • Check the layout of the holiday cottage so that in an emergency you can get out quickly and easily.
  • Check for a fire extinguisher and fire blanket, and read the instructions on their use.
  • Please be careful around the Cotter Beck and Garden. Make sure you, keep children and pets under close supervision.
  • If you are unsure of how to use any electrical appliances, please telephone.
  • If you use the night storage heaters or electric heaters, these must never be covered.
  • Take special care when moving around the property at night.
  • All activities during your holiday are undertaken at your own risk.

  • Respect the rights of land and property owners
  • Protect local wildlife
  • Follow the Countryside Code

18. COMPLAINTS

We work very hard to ensure you have an enjoyable holiday, we provide you with a points of view questionnaire and hope you will complete it and leave it in the cottage for collection.

Any difficulties you have on holiday must be reported to Cotterdale Cottage Holidays on 07850078256 straight away so that your reasonable holiday expectations may be met. This is the quickest way of resolving problems that might occur. Problems of a transient nature should be raised straight away as they cannot be rectified after your holiday. Cotterdale Cottage Holidays reserve the right to investigate and resolve any problems during rental without refund or compensation.

If still dissatisfied then you must write to us within 28 days of your return, we do not have to look at complaints received after this limit. If you return home before telling anyone of your difficulties and your claim doesn't involve personal injury/death then we cannot accept any liability.

19. ACCESS TO THE PROPERTY

There will be occasions when we will require access to the property to carry out repairs. Wherever possible we will advise you as soon as we are aware of the date and time the access is required.

20. ALTERNATIVE ACCOMMODATION

In the unlikely event that we are unable to arrange the holiday accommodation requested, or if we have to move you from accommodation you already occupy, we will endeavour to offer alternative accommodation. If the alternative accommodation is not acceptable to the holidaymaker, Cotterdale Cottage Holidays will either refund all monies paid or a pro rata amount depending on the length of stay prior to departure.

21. IF YOU CHANGE YOUR HOLIDAY

You must first telephone 07850078256. Within 8 weeks of holiday commencement we will be unable to change either the accommodation or date of your holiday. Any changes made to your booking must be authorised with Cotterdale Cottage Holidays, can only be made once and are subject to an administration fee of £50.00. If we are unable to make the change requested a new holiday may be booked and we will try and re let the original accommodation on your behalf otherwise the monies paid will be non-refundable.

22. CHANGES TO YOUR BOOKING BY COTTERDALE COTTAGE HOLIDAYS

We do not expect to make any changes to your booking but occasionally changes do occur during and after bookings have been confirmed and occasionally confirmed bookings have to be cancelled.

Cotterdale Cottage Holidays will refund the relevant portion of the rental paid. In no event shall the liability exceed the rental paid for the holiday if the cancellation occurs due to unusual or unforeseeable circumstances beyond our control the consequences of which we could not have avoided even with all due care.

We reserve the right to alter or withdraw amenities or facilities without prior notice where reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control.

23. HOLIDAY CANCELLATION INSURANCE

We recommend that you purchase Holiday Cancellation insurance from as little as £20.00 per booking (not per person), for peace of mind.

24. RELETTING ON YOUR BEHALF

If you have to cancel your holiday due to reasons not covered by the holiday cancellation insurance, we can, if requested in writing, attempt to re let your accommodation on your behalf. If successful we will refund any monies paid by the new hirer (please note this may not be the full website price, especially if it is a late booking), less the administration fee of £125.00

25. YOUR RESPONSIBILITIES

You are responsible for the property, this means you must keep all furnishings and fittings inside and outside the property in a comparable state of repair and condition as at the beginning of the holiday. The property cleanliness must be left in the same state as you found it. Breach of these conditions may result in Cotterdale Cottage Holidays making an additional cleaning charge and/or making a claim against you as a result of any damage or loss.

You are responsible to Cotterdale Cottage Holidays for the actual costs of any breakage or damage along with additional costs that may occur caused by you or any member of your party.

You are expected to show due consideration for other people, not to abuse the property or display rude, dangerous or offensive behaviour towards the owner or caretaker or other third party. Possession of the property can be refused or you can be asked to leave before the end of the holiday. If this happens we will treat your holiday as having been cancelled by you and you will not be entitled to a refund of your holiday cost or compensation.

It is your responsibility to check the holiday property meets your needs and we cannot be responsible for ensuring the property is entirely suitable for your needs. We cannot accept any bookings that are specified to be conditional upon fulfilment of a particular request.

It is your responsibility to notify us of any information regarding a medical problem or disability that may affect your holiday at the time of booking. Disabled, infirm and restricted mobility guests: the layout/features of the properties make it unsuitable for visitors with mobility difficulties.

26. LIABILITY

The owner and Cotterdale Cottage Holidays shall have no liability for any death or personal injury, loss or accident sustained by any visitor to the property however caused. You must take all necessary steps to safeguard your personal property. No liability is accepted by the owner or Cotterdale Cottage Holidays in respect of damage to, or loss of, such personal property.

Your vehicles, their accessories and contents are left entirely at your risk. Neither the Owner nor Cotterdale Cottage Holidays are responsible for any loss or damage from or to any vehicle

No responsibility can be accepted by Cotterdale Cottage Holidays or the Owner for any belongings or valuables left on the premises including a car and its contents however caused.

27. DATA PROTECTION

For the purposes of the Data Protection Act 1998, Cotterdale Cottage Holidays are the sole data controller of all personal data provided to us from customers and prospective customers.

The company will collect certain personal details from you including your name and address and credit/debit card details.

The company would like to store and use your personal details for future marketing purposes. This would cover sending brochures or details of promotions to you. Cotterdale Cottage Holidays may make contact with you by E-mail, post, fax or telephone for the purposes set out in this clause for a period of 6 years after the end date of the holiday rental. If you do not wish to receive any or all of the communications set out in this clause, please let us know by telephone or letter, e-mail or fax. The company is entitled to assume that you do not object to being communicated with unless it receives notice.

Except where expressly permitted by the Data Protection Act 1998, the company will only deal with the personal details you give as set out above. The company has appropriate security measures in place to protect this information.

28. FORCE MAJEURE

Compensation payments will not apply where we cannot fulfil our obligations due to circumstances beyond our control. This would mean any event we or the owner cannot foresee with all due care, e.g. riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire epidemic or health risk and similar factors beyond our control.

29. ELECTRICAL APPLIANCES

In the event an electrical appliance, such as TV, DVD. hot water heat. night storage heaters, cooker, fridge, washing machine, dish washer and small electrical appliances break down, it will be repaired as soon as possible. We will not pay compensation in such circumstances.

30. FREE WIFI WIRELESS BROADBAND INTERNET ACCESS

Eller Haw Cottage and Town Head House benefit from WIRELESS BROADBAND INTERNET ACCESS. To use this complimentary service, you will need to bring your own wireless enabled laptop PC, with either a Centrino mobile processor or plug in USB or PCMCIA wireless networking adaptor. Please advice us before your arrival that you wish to use the WiFi broadband and we will provide you with the necessary access password. To log onto the WiFi access, you will need to switch on your PC and ask it to scan for a new wireless network connection (this may be detected automatically dependent upon your PC setup and operating system). The wireless net work name is "Eller Haw Cottage" or "Town Head House" which will be shown with a small security padlock. Click the wireless network name to connect and you will be requested to enter a password. Please type in the password provided with your booking confirmation to complete the connection. You should then have access to both the internet and your email or web mail accounts. Please note that as this service is complimentary, we are unable to provide any technical support although connection should be quite simple if you are using Windows XP or Vista with the relevant wireless networking hardware.
